Introduction
Welcome to National Healthcare Certifications (“NHCC”). Before accessing or using any part of our website, please carefully review the following Terms of Service Agreement (“Agreement”).
Whether or not you choose to register for any of NHCC’s products or services, by (A) accessing this website (“Site”), (B) utilizing any of the content and services provided by the Site (“Services”), or (C) expressing your consent wherever applicable, you explicitly affirm and agree that you possess the requisite legal capacity to consent to, and be bound by, these Terms of Service (“Terms”). In doing so, you explicitly agree to be bound by these Terms.
In the event that you are deemed to be below the age of majority in your juridical district (a “Minor“), as defined by the applicable laws of said jurisdiction, you warrant that your use of the Site is conducted with the explicit consent of your parent or legal guardian, and further confirm that you have obtained the requisite permission from said parent or legal guardian to access the Site and accept its Terms. If you are the legal custodian, parent, or guardian of a Minor, You agree to mandate that the Minor adhere to these Terms, and to fully indemnify NHCC, its employees, partners, and executives in the event of any breach of these Terms by the Minor. If You are not at least 13 years old, You are expressly prohibited from accessing the Site, whether temporarily or permanently, and from submitting any information to the Company or the Site under any circumstances.
These Terms encompass all the provisions set forth herein, including any other terms, policies, and procedures available on our website or referenced in these Terms. This includes, but is not limited to, our Privacy Policy, Copyright Policy, and Refund Policy. IF YOU DO NOT CONSENT TO THESE TERMS, THEN IMMEDIATELY CEASE FROM USING THIS WEBSITE OR ANY OF ITS SERVICES.
The operation of this website is managed by National Healthcare Certifications, LLC. Throughout these Terms, the terms “We,” “Us,” “Our,” “Company,” and “NHCC” pertain to National Healthcare Certifications, while the terms “You,” “Your,” “User,” “Customer,” “Student,” and “Trainee” pertain to You, the user of this website. The term “User” may also pertain to other individuals or entities outside of You that use or otherwise engage with the website and/or any of its associated services. The term “Services” pertains to the content, courses, tests, certification materials, websites, web pages, and all other related content and services obtained in part or in full by You or any other User through interaction with the Company, its Site, and affiliated materials.
The Company retains the right to update, modify, or substitute any section of these Terms by posting updates or changes on its website, without prior notice. By accessing the Site and/or using any of its Services, You acknowledge and confirm that it is Your responsibility to regularly check this page for revisions, and Your continued use of the Site or any of the Company’s Services after the posting of any changes indicates Your acceptance of those modifications. You warrant that any and all information You provide to Us via the Site or Services is accurate and complete, and that the individual providing the information is either A) over the age of eighteen (18) years, or B) providing the information with the explicit consent of the individual’s parent or legal guardian as outlined above. You warrant that You are legally able and permitted to enter into this Agreement, and permitted under the laws of Your local jurisdiction to do so. If entering into this Agreement on behalf of, or in representation of, a company and/or entity of any kind, you hereby warrant that You are authorized by the entity You represent to do so.
At any time, We reserve the right to end any relationship with You if You violate these Terms.
1. Content, services, and usage
1.1
Through its Site, National Healthcare Certifications provides courses, tests, and instructor-led training sessions and assessments that encompass, but are not restricted to, online certification and recertification for CPR, AED, and First Aid. The Company does not offer services on behalf of any healthcare providers, nor does it provide health advice or assistance to You or any individual User or Users. The Company’s obligations are expressly confined to providing access to the Site, and delivering the designated Services.
1.2
The Company retains exclusive ownership rights to all content featured on the Site and as part of its Services. Accessing the Site or using any of these Services does not impart to You, the User, any ownership rights to the materials presented therein. You are granted authorization to use the Company’s Services on the condition that You adhere strictly to the Terms outlined in this agreement.
1.3
The copyright for the content on this Site, as well as all associated intellectual property rights pertinent to the Company’s Site or Services, are vested solely in the Company, unless otherwise specified for content owned by its third-party suppliers. All ownership and usage rights are subject to compliance with these Terms of Service, and You hereby acknowledge that any unauthorized use or infringement of these rights may result in legal consequences.
1.4
Throughout the Services, curriculums, and all other materials provided by the Company, publicly available clips from popular culture materials, specifically those accessible on platforms such as YouTube, including but not limited to publicly available clips from films, television shows, and musical album recordings, may be utilized for educational purposes within the curriculum framework, provided that such usage is relevant to reinforcing a concept being taught, and/or encouraging intellectual or philosophical engagement with said concept. This includes, but is not limited to, employing excerpts to stimulate thought, understanding, or discussion, enhance comprehension, or elucidate complex topics. You expressly agree that such usage shall be determined to adhere to fair use principles at all times.
1.5
By submitting or uploading any remarks, feedback, opinions, comments, information, or materials concerning the Site or the Company’s products, Content, Services, or Technologies (“Commentary”), you affirmatively declare and assure that you possess full and unrestricted ownership of the Commentary, including all associated rights, titles, and interests therein. You declare and assure that you hold adequate rights, whether implied, estoppel, or otherwise, to confer upon Us the permissions and rights outlined in this section. You hereby acknowledge that any and all Commentary that You convey to the Company automatically becomes the exclusive property of the Company. Through the act of submitting Commentary to the Company, You explicitly consent to this transfer, and hereby grant the Company an irrevocable, nonexclusive, royalty-free, and perpetual assignment of all rights, title, and interest in and to the Commentary, including any and all copyrights and other intellectual property rights inherent in such Commentary, on a global and universal scale, without incurring any form of compensation or obligation to You.
You agree that the Company is granted unrestricted liberty to use Your Commentary as it deems appropriate, including but not limited to copying, modifying, reproducing, publishing, displaying, adapting, storing, translating, creating derivative works from, and otherwise distributing the Commentary in any form. By accepting these Terms, You relinquish, and as applicable by law, waive any moral and economic rights associated with the Commentary. Furthermore, you hereby authorize NHCC to use Your name in conjunction with the reproduction and/or dissemination of Your Commentary. We alternatively reserve the right to decline posting or to promptly remove any of Your Commentary promptly and without prior notice for any reason, including if We determine, at our sole discretion, that the Commentary violates this agreement in any way.
2. Registration
2.1
The Services offered by the Company may require You to register for an account and provide the Company with basic personal information (“User Information”). This may include but is not limited to receiving and/or being allowed to create a User ID (“User ID”) to identify your account. By registering and providing User Information, you will become a registered user (“Registered User”) of the Site, and you explicitly accept and agree to these Terms, the Refund Policy (as found linked/attached below), and the Privacy Policy (as found linked/attached below). By registering for or accessing the Site, its courses, curriculums, or any of its related Content and Services, You agree to abide by all pricing and billing terms presented on the Site, including during the registration process. You affirm and guarantee that all User Information provided by You to Us is truthful, accurate, updated, and complete, and that You are solely responsible for ensuring that your User Information remains true, current, and complete through regular and timely updates. You are prohibited from (A) generating a User ID or submitting any User Information or Commentary belonging to any other individual without their express permission, B) submitting any User Information or Commentary under any name and/or identity that is not Your own legal name and/or identity, and (C) generating a User ID or submitting any User Information or Commentary that We, at our sole discretion, consider to be offensive. Failure to adhere to these conditions will be considered a violation of these Terms, and may lead to suspension or termination of Your account.
2.2
You expressly agree to maintain strict confidentiality with respect to Your User Information and all other information related to Your account, including but not limited to login credentials such as Your User ID and password(s). You are prohibited from making any unauthorized disclosure of this information to a third party, and You explicitly acknowledge and accept full responsibility for any and all activities conducted through Your account. You agree, as a material condition of these Terms, to promptly inform Us of any unauthorized use of Your account, User ID, or User Information, and You expressly acknowledge and agree to the full exemption of the Company and its affiliates, employees, officers, agents, service providers, and volunteers (“Agents”) from liability for any losses incurred by You as a result of Your failure to adhere to these requirements.
3. Rights, trademarks, and control
3.1
All proprietary elements, including but not limited to logos, images, text and written information, videos, animations, GIFs, character designs, page designs and/or layouts, interactive elements, audio elements, software functions and features provided through the Company and its Services (“Content”) are the sole exclusive property of National Healthcare Certifications. Except as explicitly permitted in this Agreement, no license or right, whether implied, precluded, or otherwise, is in any way granted to You with respect to the Site or its Content, or any Intellectual Property Rights associated with the Site or its Content.
You are expressly prohibited from altering, transmitting, reproducing, republishing, posting, creating adaptations of, creating secondary materials or derivative works from, engaging or participating in any transfer, conveyance, or sale of, distributing, performing, or exploiting any portion of the Site or Content in any way. You acknowledge that National Healthcare Certifications maintains full rights, including copyright and proprietary rights and interests, in the Services and all materials included therein, including but not limited to logos, images, text and written information, video, animations, GIFs, character designs, page designs and/or layouts, interactive elements, audio elements, software functions and features, and multimedia data on the Site, unless explicitly identified as belonging to another entity. You agree not to copy, sell, transfer, license, distribute, or make available in any way the Services, Site, or Content to any person or entity without the express written consent of NHCC. You agree to take immediate action to stop any unauthorized distribution, sale, copying, transfering, or licensing of the Services, Site, or content upon such unauthorized use becoming known to you.
3.2
Unless indicated otherwise, all branding elements (“Symbols”), including but not limited to logos, trademarks, images, service marks, banners, page headers, and any other branding elements presented, displayed, or otherwise exhibited in or around the Site and its Content, are the sole exclusive property of the Company. Except as explicitly stated otherwise in this Agreement, the linking to, displaying of, or utilization in any other form of the Symbols or any other registered alternative marks is strictly prohibited without prior written consent from the Company.
4. Privacy
4.1
Any use of the Company’s Site, Content, or Services is subject to the Company’s Privacy Policy, which can be accessed via the provided link.
4.2
You hereby consent to the Company’s utilization of all information furnished to the Site and Services by You, for the specific purpose for which You provide the information, including but not limited to facilitating transactions or enrolling You in a program or communication at Your request. You acknowledge that the Company may process, store, and disclose such information in accordance with applicable laws and regulations, including but not limited to data protection laws.
4.3
You expressly agree that the Company is absolved from any obligation to secure, protect, or safeguard personal information entered into the Site or Services by You, and you explicitly assume all risks associated with the disclosure of any information entered, including but not limited to unintended disclosure resulting from unauthorized access or monitoring of Your activities within the Services, as well as any delay, interruption, failure, or corruption of data or other information transmitted to or received from the Site or Services. By accessing or using the Site, Content, or Services, You expressly acknowledge and agree to assume full responsibility for any risks related to the disclosure of Your personal information, and You release the Company from any and all liability arising therefrom.
4.4
At any time, You retain the unrestricted right to delete Your personal information from the Site and/or Services and discontinue your use of the Services. By exercising this right, You expressly agree that the Company shall have no obligation to retain or maintain any of Your personal information following such deletion, and You release the Company from any and all liability arising from the deletion of Your personal information and cessation of Your use of the Services.
4.5
There may be circumstances in which You disclose or provide information to third parties (including but not limited to third party providers of software, services, products, payment processing, or shipping) via the Company’s Site or Services. In any such circumstance, You acknowledge and understand that these third parties are not bound by NHCC’s Privacy Policy, and that NHCC does not have control over the policies or practices of any third party or the restrictions a third party may or may not place on the use of any information disclosed to them.
5. Compliance and accreditation
5.1
The services provided by the Company have been planned and implemented in accordance with the accreditation standards of the Postgraduate Institute for Medicine (PIM), which is jointly accredited by the Accreditation Council for Continuing Medical Education (ACCME), the Accreditation Council for Pharmacy Education (ACPE), and the American Nurses Credentialing Center (ANCC). The Company’s certification and recertification courses are accepted nationally and adhere to the International Liaison Committee on Resuscitation (ILCOR) and American Heart Association (AHA)’s most recently published cognitive guidelines. Additionally, the Company’s certification and recertification courses align with the prevailing standards set forth by the Joint Commission (JCAHO). The Continuing Medical Education credits provided by the Company are categorized as Category 1 credits, denoting self-documented credits.
5.2
NHCC’s Services are not accredited by the American Heart Association, because the American Heart Association is not an approving or accrediting body that licenses, authorizes, or endorses any kind of service external to its own products and affiliated training centers. As NHCC is its own independent provider (much like HSI or Red Cross), all certifications issued by NHCC include NHCC logos and branding. 6. Permissions, obligations, and restrictions
6.1
You are granted permission to enroll in the courses made available on the Company’s Site, and to procure certifications through the Company exclusively for personal use. This authorization is expressly limited to Your purpose of reviewing and learning the provided content, as well as obtaining the certifications offered, strictly in accordance with the stipulations outlined in these Terms.
6.2
At any time, the Company reserves the right to modify, alter, or update any courses or Content offered, at the Company’s sole discretion and without prior notice. The Company retains the exclusive right, at any time and in Our sole discretion, to alter, suspend, or discontinue any portion of the Site, or the Site in its entirety, with or without prior notice. By accessing and utilizing the Site, its Content and/or Services, You expressly release the Company and its Agents from any and all liabilities associated with changes to course offerings, Content, or Services.
6.3
The Company retains the right, in Our sole discretion and without prior notice, to modify, suspend, deactivate, or terminate Your account or cease to provide any NHCC Sites, Content, Services, or applications, either in whole or in part, at any time and for any reason. You expressly agree that the Company shall bear no liability towards You or any third party for the suspension or termination of Your account, nor the suspension or termination of any NHCC Site, application, or service. Upon suspension or termination of (A) Your account access, or (B) the Site and/or Services, you will be unable to retrieve or access any information in Your account. You agree and acknowledge that you are obligated to ensure the proper backup of Your User Information, Content, Commentary, and all other information essential to You, to guarantee access to such material in the event of loss, corruption, or the cessation of any NHCC Site, NHCC Service, or suspension or termination of Your account. The Company does not download backups or export any of Your data, User Information, Content, Commentary, or any other information related to You during or after Your use of the Site and Services, nor does NHCC provide Your Content, Information, or any other data to You upon the closure of Your account.
6.4
You are under obligation to furnish all requisite equipment for Your individual use of the Company’s Services, comprising (but not limited to) a computer, WiFi router, and Internet modem. You are also under obligation to ensure Your own access to the internet, and bear any fees associated with said equipment and connections.
6.5
Your access to and utilization of the Company’s Site, Content, and/or Services are strictly limited to their designated purpose. More specifically: You are authorized to access and use the Company’s Site, Content, and Services exclusively for the purposes of (A) completing the courses provided, and (B) acquiring the certifications offered, subject to Your meeting of the stipulated qualifications for doing so. You may not copy, reproduce, or duplicate any part of the Company’s Site, Content, or Services for any purpose whatsoever. You may not commercially utilize or apply any of the Company’s Content or Services for any purpose beyond that of acquiring a certification for Yourself individually. Any commercial utilization or application of the Company’s Site, Content, or Services requires the Company’s explicit written consent, obtained separately from this agreement. Any deviation from these Terms may result in legal action.
6.6
You expressly agree not to upload any unauthorized or malicious information onto the Company’s webpages, Site, or any and all related Services. Furthermore, You commit not to upload or deploy any computer virus, malware, or other computer program of any type designed to disrupt the regular operation of the Company’s Site or Services. Any breach of this commitment may result in the termination of Your access to the Site and Services, and be subject to legal consequences.
6.7
By utilizing the Company’s Site, Content, and Services, You expressly agree not to upload any information to the Site (including but not limited to Commentary and User Information) unless You possess rightful ownership or explicit authorization to post such information on the Site. Your use of the Company’s Services and submission of any information to the Site signifies and affirms that You either own the materials or possess the requisite authorization to post said information on the Site. Moreover: You hereby grant the Company an irrevocable, perpetual, and non-cancellable license to utilize any materials You submit to Us in a manner the Company deems appropriate. You further warrant and assure that all materials provided by You do not infringe upon any intellectual property rights of third parties, and they do not violate any right of privacy or publicity of any third party. You commit not to submit or post any materials on Our Site that are illegal or obscene.
7. Electronic communications
7.1
You acknowledge and agree that NHCC may provide through its Site and/or Services certain features that enable electronic messages (“Messages”) to be sent through the site to You and other Users, including but not limited to emails, texts and/or SMS messages. These Messages may be sent to you by Us or any other User from the entity, company, or organization You represent and/or are associated with. You acknowledge and agree that You will receive periodic Messages and updates from Us, and You consent to NHCC sending you emails and messages until such time that You advise Us otherwise.
8. Payment
8.1
In order to access the Company’s certification courses, You are obligated to pay the prescribed fees associated with the Company’s Services as outlined on the Site. Payment is to be remitted immediately upon the provision of Services. In the event of untimely payment or failure to remit payment entirely, You acknowledge and agree that the Company reserves the right to terminate your access to the Site and cease the provision of any Services to You.
8.2
By providing Your credit card information, you expressly authorize the Company to charge your credit card for all Services rendered to You.
8.3
The Company’s Services are solely accessible for purchase online via the Company’s website. The availability of these products and/or Services may be limited, and any return or exchange is contingent upon adherence to the terms specified in the Company’s Refund Policy (below).
9. Assurances, representations, and warranties
9.1
The Company expressly disclaims any and all warranties, express or implied, concerning the information presented within the Site, Content, Services, and the courses and curriculums therein, which are provided “as is.” The Company makes no warranties or representations whatsoever, express or implied, concerning the use or results of using this Site in any form, and expressly disclaims any and all warranties, express or implied, of (A) merchantability, (B) fitness for any particular purpose, and (C) title or non-infringement. YOU EXPLICITLY AGREE THAT ANY AND ALL STATEMENTS OUTSIDE THESE TERMS, WHETHER ORAL OR WRITTEN, MADE BY NHCC’S STAFF, EMPLOYEES, EXECUTIVES, VOLUNTEERS, USERS, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO STATEMENTS REGARDING ACCURACY, CAPACITY, OR SUITABILITY FOR USE OR PERFORMANCE, SHALL NOT CONSTITUTE A WARRANTY OR PROMISE BY NHCC. YOU FURTHER ACKNOWLEDGE AND AGREE THAT NHCC SHALL BEAR NO RESPONSIBILITY OR LIABILITY FOR ANY SUCH STATEMENTS, AND AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS NHCC FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, LIABILITIES, DAMAGES, LOSSES, COSTS, AND EXPENSES, INCLUDING BUT NOT LIMITED TO LEGAL FEES, ARISING OUT OF OR IN ANY WAY CONNECTED TO ANY SUCH STATEMENTS.
9.2
You expressly acknowledge and agree that NHCC shall not be held or considered responsible for the timeliness, deletion, misdelivery, or failure to store any communication, information, or content, including but not limited to failures caused by technical errors, system malfunctions, network interruptions, or any other reason.
9.3
NHCC, along with its Agents, does not guarantee in any way that the Site will remain available, operate as described, function consistently, be uninterrupted, error-free, accurate, precise, free of harmful features or components, or meet Your or any other User’s expectations for the services provided, any results or outcomes arising from said services, nor any other expectations whatsoever. You expressly acknowledge and agree that NHCC and its Agents shall bear no responsibility for (A) any inaccuracies, errors, or interruptions in service, such as system failures or power outages; or (B) any unauthorized alterations, access, deletions, destructions, damages, or losses affecting your content, data, images, text, or other information.
9.4
By engaging with the Company’s services, You explicitly acknowledge that it is Your independent responsibility to verify, confirm, and ensure the satisfaction of Your employer’s, institution’s, or state’s specific requirements concerning certification. You assume full responsibility for making these and all other confirmations. You explicitly acknowledge that acquiring a certification card or certificate (“Certificate”) from the Company, and/or possessing said Certificate, does not automatically establish You as “qualified” to (A) proficiently respond to exposure to blood (bloodborne pathogens), (B) perform adult, child, or infant CPR/AED, choking, or First Aid techniques, or (C) perform any other skills obtained from additional courses available on the Site. The Company disclaims any representation of its Certificates as such unequivocal qualifications, and emphasizes Your responsibility as the User to diligently validate any Certificate’s applicability to Your intended use.
10. Indemnification and limitation of liabilities
10.1
THE COMPANY DISCLAIMS ANY LIABILITY TO YOU, OR ANY USER OF THE SITE AND/OR SERVICES, FOR ANY AND ALL INDIRECT OR CONSEQUENTIAL DAMAGES ARISING FROM OR CONNECTED TO THE UTILIZATION OF INFORMATION PRESENT ON THIS WEBSITE. This includes but is not limited to special, direct, indirect, exemplary, consequential, or incidental damages, as well as damages for lost profits, loss of revenue, loss of use, or loss of life arising from or related to this website or the information contained within it in any way.
10.2
YOU ACCEPT COMPLETE RESPONSIBILITY AND RISK FOR USING THE SITE, SERVICES, CONTENT, AND ANY LINKED MATERIALS, WEBSITES, SERVICES, OR CONTENT. IN THE EVENT OF YOUR DISSATISFACTION WITH OR OBJECTION TO THE TERMS OF THIS AGREEMENT OR THE SITE, CONTENT, OR SERVICES, YOUR SOLE AND EXCLUSIVE RECOURSE AND ONLY REMEDY IS TO CEASE YOUR USE OF THE SITE, SERVICES, CONTENT, INFORMATION, OR LINKED WEBSITES OR MATERIALS, IRRESPECTIVE OF WHETHER SUCH RIGHT OR REMEDY IS PERCEIVED AS EFFECTIVE OR INEFFECTIVE IN ITS ESSENTIAL PURPOSE. IT IS EXPLICITLY RECOGNIZED, AND YOU AFFIRM HEREBY, THAT WE ASSUME NO ADDITIONAL OBLIGATION, LIABILITY, OR RESPONSIBILITY TO YOU OR ANY OTHER PARTY.
IN ANY EVENT, THE TOTAL LIABILITY OF NHCC AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, SUPPLIERS, EMPLOYEES, OFFICERS, EXECUTIVES AND PARTNERS UNDER THESE TERMS OF USE, INCLUDING BUT NOT LIMITED TO DAMAGES, LOSSES, AND CAUSES OF ACTION — WHETHER IN CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE — IS CAPPED AT THE AMOUNT, IF ANY, PAID BY YOU FOR ACCESS TO THE SERVICE. Certain jurisdictions may not permit the exclusion of incidental or consequential damages or limitations on the duration of implied warranties, thereby some of the above provisions may not be applicable to You. If any of the provisions of this Section are determined and/or held to be void or unenforceable, then such provisions shall be limited to the absolute minimum extent necessary, and subsequently augmented or replaced with a valid provision that most accurately represents the intent of these Terms.
10.3
You unequivocally agree to fully indemnify, defend, and hold NHCC, as well as any of its Agents, harmless and immune from any and all claims, damages, loss, liability, suits, or expenses, whether direct or indirect, arising from, connected to, or in any manner associated with Your use of the Site, Content, or Services. This indemnification encompasses, but is not limited to, legal costs, attorney fees, and any other expenditures incurred in the defense against such claims. These damages may occur under any number of legal theories, including but not limited to contract, negligence, tort, statutory violations, equity, or other legal grounds, even if NHCC has been informed of the potential for such damages, and this indemnification and limitation of liability is applicable regardless of whether the claim arises from breach of contract, breach of warranty, negligence, strict liability, lost opportunity, or otherwise, and irrespective of Your knowledge — either actual, constructive, imputed, inferred, presumed, objective, or subjective — of the possibility of incurring such damages.
You agree that NHCC’s liability under this indemnification provision shall not be limited by any cap on liability stated elsewhere in these Terms of Service. This indemnification obligation shall survive the termination or expiration of these Terms of Service and Your use of the Site, Content, or Services.
10.4
By accessing and using this website, You explicitly release the Company from any and all liabilities to the maximum extent permitted by law. If any of the provisions of this Section are determined and/or held to be void or unenforceable, then such provisions shall be limited to the absolute minimum extent necessary, and subsequently augmented or replaced with a valid provision that most accurately represents the intent of these Terms.
10.5
Additionally, it is Your responsibility to carefully read, understand, and agree to the Company’s Terms of Service, Refund Policy, and Privacy Policy before completing registration for the Site or any of its Courses, Services, or Content. To file a notice of copyright infringement, You must provide the following information: (A) Your full legal name, address, telephone number, and email address; (B) A detailed description of the copyrighted work purportedly subject to infringement; (C) A description of the specific location on the Site or within the Content where the allegedly infringing material can be found, including URLs, screen captures, or any other pertinent information that will assist in identifying the material in question; (D) An clear statement confirming Your belief, made in good faith, that the use of the copyrighted material in question is unauthorized by You, the rightful copyright owner, its designated agent, or by applicable law; (E) An electronic or physical signature provided by an individual who is legally authorized to act on behalf of the copyright owner, demonstrating their authority to represent and enforce the copyright interests in question; (F) A statement, declared under penalty of perjury, attesting to the accuracy of the information contained within the notice, and asserting that You are either the rightful copyright owner or possess the legal authority to act on behalf of the copyright owner regarding the alleged infringement. NHCC strongly advises you to carefully review and understand all applicable policies before engaging with any external website or providing any personal data.
Limitation of Liability – Under no circumstances shall NHCC, its owners, managers, employees, contractors, affiliates, or representatives be held responsible or liable, directly or indirectly, for any claims, damages, expenses, or losses (whether actual, consequential, punitive, incidental, or otherwise) arising from or related to your access, use, or reliance on any third-party website or its content, goods, or services.
No Warranty – NHCC makes no representations or warranties, express or implied, regarding the quality, security, or accuracy of third-party websites. We do not guarantee that any external site will be free from harmful components or that your use of such sites will be uninterrupted or error-free.

13. Corporate and organizational purchasers
If You are an entity, including but not limited to a corporation, limited liability company, partnership, nonprofit organization, educational institution, government agency, or any other business, legal entity, or other type of group (hereinafter “Entity Purchaser”), and You purchase training, certification, or other services from NHCC for the benefit of Your employees, members, agents, representatives, contractors, or any other individuals affiliated with Your Entity (“End Users”), You expressly acknowledge and agree to the following additional terms:
13.1
By purchasing or otherwise utilizing NHCC’s Services on behalf of employees, members, or any other affiliated individuals, the Entity Purchaser expressly acknowledges, agrees, and warrants that it, along with all End Users for whom it has procured access to NHCC’s training or certification programs, is fully bound by and subject to all terms, conditions, policies, disclaimers, and legal provisions set forth on NHCC’s website, including but not limited to the Terms of Service, Privacy Policy, Refund Policy, and any other agreements, rules, or guidelines governing the use of NHCC’s Services.
The Entity Purchaser’s agreement to these terms is implied by its purchase, registration, or continued use of NHCC’s Services, regardless of whether the Entity Purchaser or its End Users have individually reviewed or explicitly acknowledged such terms. It is the Entity Purchaser’s sole responsibility to ensure that all End Users are informed of and comply with these terms.
Any Entity Purchaser that does not agree to the entirety of NHCC’s Terms, Policies, and Conditions is strictly prohibited from purchasing or utilizing NHCC’s Services, and any such unauthorized use shall be deemed a material breach of these Terms, rendering any certifications issued under such circumstances null and void.
13.2
The Entity Purchaser assumes all liability for the End Users’ use of the Site, Services, or Content. NHCC shall bear no responsibility for any claims, damages, losses, or liabilities arising from the actions, inactions, or reliance on the Content or Services by the Entity Purchaser or any End User. The Entity Purchaser acknowledges that it is solely responsible for ensuring that End Users are properly trained and meet any applicable regulatory, legal, or employer-specific requirements.
13.3
The Entity Purchaser agrees to fully indemnify, defend, and hold harmless NHCC and its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, demands, losses, liabilities, damages, costs, or expenses (including, but not limited to, attorneys’ fees and court costs) arising out of or related to (A) Any action or inaction by the Entity Purchaser or its End Users in relation to the use or misuse of NHCC’s Services or Content; (B) Any misrepresentation, whether intentional, negligent, or unintentional, made by the Entity Purchaser regarding the sufficiency, validity, or regulatory compliance of the training or certification provided by NHCC — including, but not limited to, any instance in which the Entity Purchaser believes NHCC’s training or certification will satisfy specific legal, industry, or employer requirements, but later discovers that such belief was incorrect; (C) Any failure by the Entity Purchaser to comply with applicable laws, rules, or regulations related to training or certification requirements. As stated in Section 9 of these Terms, both the Entity Purchaser and any affiliated End Users expressly acknowledge and affirm that it is their sole responsibility to determine whether the Services meet any applicable requirements, and to ensure compliance with any and all applicable laws or industry regulations.
13.4
By being enrolled in or signed up for NHCC’s website, training courses, or certification programs — whether by their own volition or by an Entity Purchaser on their behalf — each End User is individually and independently bound by NHCC’s Terms of Service, Privacy Policy, and all other policies applicable to users of NHCC’s Services. This applies even if the End User was enrolled in NHCC’s Services by an Entity Purchaser and did not directly interact with NHCC’s sign-up process. The Entity Purchaser acknowledges and affirms that NHCC shall not be held liable for any claims brought by an End User related to their use of the Services, including but not limited to claims for insufficient training, lack of competency, or failure to obtain certification.
13.5
The Entity Purchaser acknowledges that NHCC training and certification services are provided on an individual basis and are non-transferable. No Entity Purchaser shall represent or attempt to certify individuals who have not personally completed the required training. Any unauthorized assignment, sharing, or transfer of accounts, certifications, or other materials is strictly prohibited and shall render such certifications null and void.
14. Data retention and deletion
14.1
NHCC maintains records of all certifications issued to users who have successfully passed a course. These records are retained for a period of five (5) years from the date on which the user successfully completes the certification requirements and is awarded a certificate (“Retention Period”). This Retention Period consists of the following:
Certification Validity Period (Two Years): Certification remains valid for a period of two (2) years from the date of issuance, as defined by NHCC’s certification standards.
Extended Record Maintenance (Three Additional Years): An additional three-year retention period is implemented for administrative, record-keeping, and customer service purposes, allowing Users to request copies of their certification records during this time.
14.2
Upon the expiration of the five-year Retention Period, all certification records associated with the User—including, but not limited to, the certification itself, course completion records, and examination results—will be permanently deleted from NHCC’s databases and systems. This deletion process is conducted in accordance with NHCC’s internal data management policies to ensure data cleanliness and compliance with best practices for information security.
14.3
Users and Entity Purchasers are solely responsible for maintaining their own records of certifications. Prior to the deletion of their records, Users may request copies of their certifications or other related documents. Once certification records are deleted, NHCC will be unable to recover, reproduce, or verify any certification history. Users and Entity Purchasers are strongly advised to download and retain their certification documents within the five-year Retention Period.
14.4
NHCC shall bear no responsibility or liability for any loss, inconvenience, or damages incurred by You or any other party due to the deletion of certification records at any time, including but not limited to the time during or after after the five-year Retention Period. This includes, but is not limited to, any inability to verify certification status for employment, regulatory, or educational purposes. By using NHCC’s services, You acknowledge and agree to this record retention and deletion policy.
14.5
In certain cases, NHCC may be required to retain records beyond the five-year Retention Period due to legal, regulatory, or compliance obligations. If such retention is required by law or official governmental request, NHCC reserves the right to maintain certification records for the period necessary to comply with such obligations.
14.6
NHCC reserves the right, at its sole discretion, to retain certification records and/or User, Entity Purchaser, and any other data or information beyond the standard five-year Retention Period for any reason it deems necessary. Such reasons may include, but are not limited to:
• Internal audits, quality control, or system maintenance
• Compliance with evolving industry standards, accreditation requirements, or contractual obligations
• Investigations related to suspected violations of NHCC’s Terms of Service, misconduct, or fraud
• Enhancing user experience by providing continued access to historical certification records
The exercise of NHCC’s discretion to retain records beyond the standard Retention Period shall not constitute an obligation to maintain such records indefinitely. NHCC may delete such records at any time without prior notice. You hereby acknowledge and agree that NHCC retains sole authority in determining whether and for how long to retain any certification records or other data beyond the stated five-year period.
